Terms of Service – Nourish Awards Guest Access Portal

These Terms of Service (“Terms”) govern your use of the Nourish Mediag Group Ltd (trading as Nourish Awards) guest access portal (“Portal”). By accessing and using the Portal, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Portal.

1. Use of the Portal

The Portal is provided for the purpose of managing award entries, viewing entry status, submitting product information, receiving judges’ feedback, and downloading award certificates and logos. You agree to use the Portal only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the Portal in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to the Portal or its systems
  • Transmit viruses, malware, or any code of destructive nature
  • Disrupt the normal flow of dialogue within the Portal
  • Share your login credentials with unauthorized individuals
  • Use the Portal to impersonate or misrepresent your identity or affiliation

2. User Accounts and Access

Authentication: You will receive a one-time login code via email to access the Portal. You are responsible for maintaining the confidentiality of this code and for all activities that occur under your account.

Accuracy of Information: You agree to provide accurate, current, and complete information when registering and using the Portal. You are responsible for updating your information if it changes.

Account Termination: Nourish Awards reserves the right to suspend or terminate your access to the Portal at any time for violations of these Terms or for any other reason at our sole discretion.

3. Entry Submission and Product Information

Responsibility for Content: You are solely responsible for all product information, descriptions, ingredients, claims, and certifications you submit through the Portal. You warrant that:

  • All information is accurate and truthful
  • You have the right to submit the product information
  • The product complies with all applicable laws and regulations
  • You own or have authorization to represent the products entered

Judging Process: Nourish Awards judges products based on nutrition, ingredients, innovation, taste, texture, and other criteria as outlined in our judging guidelines. Judges’ decisions are final and binding. We do not guarantee any specific outcome or award tier.

4. Intellectual Property

Your Content: You retain ownership of all product information and content you submit. By submitting content, you grant Nourish Awards a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your product information for award administration, feedback, and promotional purposes (including winners databases, yearbooks, and marketing materials).

Award Logos and Certificates: Award logos and certificates are provided for use by winners. You may use these materials in accordance with our usage guidelines, typically for up to two years from the award date.

Portal Content: All content on the Portal, including text, graphics, logos, and software, is the property of Nourish Awards or its content suppliers and is protected by copyright and other intellectual property laws.

5. Payment Terms

Entry Fees: Entry fees are non-refundable once submitted, except in cases of technical errors or at Nourish Awards’ sole discretion.

Payment Processing: Payments are processed through Stripe. By submitting payment information, you authorize Stripe to charge your payment method for the entry fee. Please refer to Stripe’s Terms of Service for payment processing details.

Invoicing: Invoices are issued via Xero and sent to the email address associated with your account.

Volume Discounts: Volume and category bundle discounts are applied automatically based on the number of entries and categories selected. Discounts are calculated and applied at checkout.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOURISH AWARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PORTAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOURISH AWARDS’ TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PORTAL SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR ENTRY FEE.

7. Disclaimer of Warranties

THE PORTAL IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. NOURISH AWARDS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PORTAL, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

NOURISH AWARDS DOES NOT WARRANT THAT:

  • The Portal will be uninterrupted or error-free
  • Defects will be corrected
  • The Portal is free from viruses or harmful components

8. Indemnification

You agree to indemnify, defend, and hold harmless Nourish Awards, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

  • Your use of the Portal
  • Your violation of these Terms
  • Your submission of inaccurate or unlawful product information
  • Your infringement of any third-party rights
  • Any product liability claims related to products you entered

9. Confidentiality

Judges’ feedback and scoring are confidential and provided for your benefit. You agree not to publicly disclose judges’ comments or scores without permission from Nourish Awards, except as permitted for marketing purposes “Judges feedback” document.

10. Data and Privacy

Your use of the Portal is governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices, including how we collect, use, and share your information.

11. Modification of Terms

Nourish Awards reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Portal. Your continued use of the Portal following the posting of revised Terms means that you accept and agree to the changes.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

Dispute Resolution: Any dispute arising out of or relating to these Terms or the Portal shall first be subject to good faith negotiation between the parties. If negotiation fails, disputes shall be resolved through arbitration or litigation in the courts of the United Kingdom, as applicable.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nourish Awards regarding your use of the Portal and supersede all prior agreements and understandings.
